Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the website at https://permanentmakeup.ai and the services provided by Permanent Makeup AI (the “Service”). By creating an account, uploading a photo, or otherwise using the Service, you agree to be bound by these Terms.

1. The Service

Permanent Makeup AI lets you upload a photograph of yourself and generates AI-rendered preview images of what permanent makeup styles (microblading, lip blush, eyeliner, beauty marks, and related procedures) could look like on your face. The Service is a planning and visualization tool. It does not perform any cosmetic procedure, it is not a medical device, and it does not provide medical, dermatological, or clinical advice.

2. AI-Generated Output Disclaimer

Preview images generated by the Service are illustrative only. They are not a guarantee, prediction, or representation of any real-world permanent makeup result. Real outcomes depend on your skin, the technique and pigment your artist uses, and how your skin heals. You agree not to rely on a preview as a basis for any medical decision, and you agree to consult a licensed permanent makeup artist or medical professional before undertaking any procedure.

3. Eligibility

You must be at least eighteen (18) years old to use the Service. By using the Service you represent that you are at least eighteen and that you have the right to upload any photograph you submit.

4. Account and Credits

You may need to create an account to access certain features. You are responsible for keeping your sign-in credentials secure and for everything that happens under your account. The Service uses a credits system: you purchase credit packs from us, and each generation consumes credits at the rate disclosed on the pricing page.

Credits are non-transferable, have no cash value, and do not expire while your account is in good standing. We may adjust pricing and credit costs prospectively with notice; previously purchased credits will retain their value at the time of purchase.

5. Photo Upload and Biometric Consent

To generate a preview, you upload a photograph of yourself. You represent and warrant that:

  • You are the person depicted in the photograph
  • You have the right to upload the photograph
  • The photograph does not infringe on anyone's rights

You provide your explicit, informed consent for us to process the photograph for the sole purpose of generating the preview image you have requested, as described in our Privacy Policy. We do not use your photograph to train AI models, identify you, or share it with any party outside the third-party processors disclosed in the Privacy Policy.

If you are in Illinois or otherwise covered by the Illinois Biometric Information Privacy Act, please see Section 3 of our Privacy Policy for the full terms of your biometric consent and your right to withdraw it.

6. Output Images and Your License

You retain all rights you have in the photograph you upload. We grant you a personal, worldwide, royalty-free license to download, share, and use the preview images we generate from your photograph for non-commercial purposes, including showing them to a permanent makeup artist as part of a consultation.

You may not use Output Images to misrepresent the identity of another person, to harass anyone, or for any unlawful purpose. You may not resell Output Images as your own commercial work.

7. Acceptable Use

You agree not to:

  • Upload a photograph of anyone other than yourself
  • Upload nude, sexual, violent, hateful, or otherwise unlawful content
  • Use the Service to harass, deceive, impersonate, or defame any person
  • Attempt to reverse engineer, scrape, or otherwise interfere with the Service or its underlying AI models
  • Resell, sublicense, or commercially exploit access to the Service without our written permission

We may suspend or terminate accounts that violate these rules.

8. Refunds

We offer refunds for unused credits within fourteen (14) days of purchase, provided you have not generated more than three (3) previews from the credit pack. To request a refund, email support@mg.permanentmakeup.ai with your purchase details. Refunds for partially used packs are at our reasonable discretion.

9. Third-Party Services

The Service relies on third-party processors disclosed in our Privacy Policy (including Replicate, Supabase, Stripe, Google, and Resend). Your use of the Service is subject to their respective terms where applicable.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PREVIEW IMAGES WILL MATCH ANY REAL-WORLD PROCEDURE OUTCOME.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PERMANENT MAKEUP AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnity

You agree to indemnify and hold Permanent Makeup AI harmless from any claim arising out of (a) your breach of these Terms, (b) your uploaded photograph, or (c) your use of any Output Image.

13. Termination

You may delete your account at any time from your dashboard or by emailing support@mg.permanentmakeup.ai. We may suspend or terminate accounts that violate these Terms or that show signs of fraud or abuse. Sections that by their nature survive termination (including disclaimers, limits of liability, and indemnity) will continue to apply.

14. Changes to these Terms

We may update these Terms. If we make a material change, we will notify you by email or through a prominent notice in the product before the change takes effect. The “Last Updated” date at the top of this page always reflects the current version. Your continued use of the Service after a change constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Where applicable consumer protection law in your country of residence provides stronger protections, those protections apply.
